Referrals

At Malecki Law, we have a long history of working with other attorneys on securities cases they refer to us. Over the years, we have cultivated strong relationships with attorneys in different practice areas around the country and we appreciate the confidence they place in us by letting us represent their clients. These referrals are a complement to our work ethic and expertise in the field of securities law. We value the trust they place in us and we endeavor to work out fee-sharing agreements in every case, favorable to the referring attorney while adhering to the code of ethical standards. Our attorneys will also ensure that the total fees do not exceed, “reasonable compensation for all legal services…rendered the client.” [DR 2-107(A)(3).]

Once a case is referred to us we are happy to work on the case jointly, or happy to take the case over completely, depending on what the client needs are and what the specific situation calls for at the time the case is referred to us. We work with attorneys within the state of New York, throughout the United States, and all over the world in securities litigation, arbitration, and mediation matters. We understand that many clients are not familiar with the process of referrals and may not understand why the attorney they retained is now looking to refer the matter to another lawyer or law firm. It is important for clients to understand that their lawyer is following his or her fiduciary duty when doing so, as well as that they are not charged any additional fees for that referral. As a lawyer, we want to ensure our clients’ needs are met and they are represented in a competent, complete, and professional manner—we are obligated to do so, ethically and professionally. Many areas of law, like the ones we focus on here at Malecki Law, are complex and require a lawyer who knows “the law of the land.” As an attorney, trying a case in an area of law in which one is not well-versed is a disservice to all involved as well as ethically, professionally, and morally questionable, and most attorneys know this. As a client, if you are unsure how well-versed your attorney is in a specific area of law you should ask questions. You do not need to know the area of law. Ask questions about your attorney’s experience in that specific area in question. How many clients has your attorney represented in this legal area? How many years has your attorney been working in this area? Do other attorneys refer business to your lawyer for this area of law? Asking these and similar questions will not offend your attorney. An experienced and responsible attorney will appreciate and understand your due diligence.It will help you gain a better understanding of whether or not it might be beneficial for your attorney to bring additional experienced counsel on to the case.
